2. Hosting and Access Data
This website is hosted by STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany.
When you access the website, technically necessary access data is processed. This may include the page or file accessed, date and time of access, referrer, browser, operating system and IP address.
According to STRATO, IP addresses are retained for a maximum of seven days for the detection and prevention of attacks. The log files made available to us contain anonymized host names or IP addresses.
We also use the website statistics provided by STRATO for a basic analysis of website usage. We do not use our own persistent visitor identifier for this purpose.
The processing is based on Art. 6(1)(f) GDPR. Our legitimate interests are the secure and technically reliable operation of the website and a basic evaluation of its use.
We have entered into a data processing agreement with STRATO pursuant to Art. 28 GDPR.
3. Contacting Us
If you contact us by email or through the contact form, we process the information you provide in order to respond to your enquiry.
The contact form processes your name, email address and message. In addition, technically necessary data is processed to secure the form and prevent misuse.
The contact form uses a technically necessary session cookie as well as server-side security measures such as CSRF protection, input validation, a honeypot, a minimum completion time and temporary rate limiting. The session cookie is used solely for the security and functionality of the contact form requested by you. No consent is required for this technically necessary cookie under Section 25(2) No. 2 of the German Telecommunications Digital Services Data Protection Act (TDDDG).
Messages are not permanently stored in a separate website database. Enquiries and the associated data are deleted once they are no longer required to process the enquiry and any subsequent communication, unless statutory retention obligations or other legitimate reasons require further storage.
Where your enquiry relates to a contract or pre-contractual measures, processing is based on Art. 6(1)(b) GDPR. In all other cases, processing is based on Art. 6(1)(f) GDPR on the basis of our legitimate interest in responding to enquiries and protecting the contact form against misuse.
4. Newsletter
You can subscribe to our newsletter on this website. We require your email address for this purpose.
Processing is based on your consent pursuant to Art. 6(1)(a) GDPR. Promotional emails are sent in accordance with Section 7 of the German Act Against Unfair Competition (UWG).
We use a double opt-in process. After subscribing, you will receive an email containing a confirmation link. Your address is only enabled for regular newsletter delivery after you confirm the subscription.
Unconfirmed subscriptions are not used for regular newsletter distribution. The confirmation process also serves as evidence of the consent given.
We use Brevo as our newsletter service provider and data processor for the administration and delivery of the newsletter. Brevo provides a data processing agreement pursuant to Art. 28 GDPR as part of its Terms of Service.
According to Brevo, the database servers on which it processes and stores data are located within the European Union. Where additional service providers outside the European Economic Area are used and personal data is transferred to them, such transfers are made in accordance with the requirements of Art. 44 et seq. GDPR.
Newsletter opens and link clicks are not evaluated on an individual subscriber basis unless separate tracking consent has been provided. Our website does not currently obtain such additional tracking consent.
You may withdraw your newsletter consent at any time with effect for the future, in particular by using the unsubscribe option provided in the newsletter or by emailing info@marcokaschuba.com. The lawfulness of processing carried out before the withdrawal remains unaffected.
After unsubscribing, your address will no longer be used for regular newsletter delivery. Data required to demonstrate a previously granted consent or to defend legal claims may be retained for the applicable statutory retention and limitation periods.
5. Your Rights
Subject to the applicable legal requirements, you have the right to obtain information about your personal data, to have inaccurate data corrected, to request erasure or restriction of processing and to receive your data in a portable format.
You may withdraw any consent you have given at any time with effect for the future.
Where processing is based on Art. 6(1)(f) GDPR, you also have the right to object to the processing in accordance with Art. 21 GDPR.
To exercise your rights, please contact info@marcokaschuba.com.
